1. Agreement to Terms

By accessing or using the Fat2Fit application ("the App"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use the App.

2. Description of Service

Fat2Fit is a health and fitness application that provides:

• Food image analysis and nutritional information
• Personalized dietary recommendations
• Calorie and nutrition tracking
• Progress monitoring towards health goals

3. User Accounts

To use the App, you must:

• Be at least 13 years of age
• Provide accurate and complete information
• Maintain the security of your account
• Notify us immediately of any unauthorized access

4. User Responsibilities

You agree to:

• Use the App for its intended purpose
• Not misuse or attempt to circumvent the App's features
• Not upload harmful content or malware
• Not infringe on others' intellectual property rights
• Comply with all applicable laws and regulations

5. Health Disclaimer

The App provides general health and nutrition information and is not a substitute for professional medical advice. Consult healthcare professionals before starting any diet or exercise program. We are not responsible for any health problems that may result from using the App.

6. Weight Loss and Results Disclaimer

Important notices regarding weight loss and results:

• We do not guarantee any specific weight loss results
• Results vary significantly based on individual effort, dedication, and lifestyle choices
• Success depends entirely on the user's commitment and adherence to their health goals
• Our recommendations are not scientifically guaranteed to work for everyone
• The app is a tool to assist your journey, but outcomes depend on your personal effort
• Weight loss results may vary and are not typical for all users

7. AI and Analysis Accuracy

While we strive for accuracy in our food analysis and nutritional information:

• AI analysis may not be 100% accurate
• Results should be used as estimates only
• Users should verify information if precise measurements are needed
• We are not liable for decisions made based on analysis results

8. Intellectual Property

The App and its original content, features, and functionality are owned by Fat2Fit and are protected by international copyright, trademark, and other intellectual property laws.

9. Subscription and Payments

9.1 Subscription Terms

By subscribing to Fat2Fit Premium, you agree to the following terms:

• Subscription periods are available in weekly ($X.XX/week) and yearly ($XX.XX/year) options
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• Billing occurs at the start of each subscription period
• Price changes will be notified via email at least 30 days before taking effect
• Current subscription period charges are non-refundable

9.2 Free Trial

Free trial terms:

• New users are eligible for a X-day free trial of Premium features
• Trial automatically converts to paid subscription unless cancelled
• One trial per user; previous trial users are not eligible
• Trial can be cancelled anytime before the trial period ends
• Some premium features may be limited during trial period

9.3 Refund Policy

Refund requests are handled through the App Store:

• All refund requests must be submitted through Apple's App Store
• We cannot process refunds directly
• Refund eligibility is determined by Apple's policies
• To request a refund:
  1. Visit reportaproblem.apple.com
  2. Sign in with your Apple ID
  3. Find the Fat2Fit subscription purchase
  4. Select "Request a refund" and follow the instructions

9.4 Subscription Management

To manage your subscription:

• iOS/iPadOS users:
  1. Open Settings on your device
  2. Tap your Apple ID at the top
  3. Tap Subscriptions
  4. Find Fat2Fit in the list
  5. Choose "Cancel Subscription" or change your plan
• Cancellation takes effect at the end of the current billing period
• Access to premium features continues until the end of the paid period
• No refunds for partial subscription periods

10. Termination and Data Deletion

We may terminate or suspend your account and access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You have the right to request complete deletion of your account and all associated data at any time. Upon such request:

• All your personal information will be permanently deleted
• Your food logs and analysis history will be removed
• Your images will be deleted from our storage
• Any associated data will be permanently erased

You can delete your account and data in two ways:

1. In-App Deletion: For immediate deletion, go to:
   • Open the Fat2Fit app
   • Navigate to Settings
   • Select Privacy
   • Choose Delete Account
   • Follow the confirmation steps

Note: Account deletion is permanent and cannot be undone.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Fat2Fit and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App.
• Our total liability for any claims relating to the App shall not exceed the amount you paid for the App in the past 12 months, or $100, whichever is less.
• We are not liable for any damages or injuries resulting from:
  • Your use or misuse of the App
  • Any dietary or fitness decisions you make based on the App
  • Inaccuracies in food analysis or nutritional information
  • Technical issues or service interruptions
  • Third-party services or content

11.1 Indemnification

You agree to indemnify, defend, and hold harmless Fat2Fit, its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms of Service
• Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property or privacy right
• Any claims that your use of the App caused damage to a third party

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via the App or email.

13. Dispute Resolution

Please read this section carefully as it affects your rights.

13.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at hello@fat2-fit.site. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Fat2Fit may proceed with filing a formal claim.

13.2 Agreement to Arbitrate

You and Fat2Fit agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the App shall be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

13.3 Class Action Waiver

YOU AND FAT2FIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
